Bench Lane 07 · Heirship, Probate & Curative

Probate & Heirship Research Landman Work.

When mineral interests pass through three or four generations without a local probate filing, drilling opinions and division orders stall until a landman traces the family tree, pulls out-of-state estate packets, interviews disinterested witnesses, and records the curative instruments.

Nothing is promised. Signing puts your counties and experience on our bench list so we can reach out when an operator or broker sends a matching request.

Re What we record when you sign for probate and heirship work

  1. State intestate succession and community-property rules. Texas community-property vs. separate-property descent (and pre-1993 community-property survivorship rules), Louisiana forced heirship and Judgments of Possession, and Oklahoma/New Mexico probate rules each change how fractional mineral shares descend.

  2. Out-of-state probate and ancillary filings. When a mineral owner died in California or Illinois leaving a will that was never filed in the county where the minerals sit, curative hands locate the domiciliary court packet and order exemplified copies for recording or ancillary administration.

  3. Affidavits of Heirship (AOH) that pass opinion review. Drafting complete marital, child, and predeceased-heir histories and securing signatures from two disinterested witnesses who knew the decedent, formatted to satisfy examining counsel and state marketable-title statutes.

  4. Locating missing heirs and clearing suspense. Documented skip-tracing, obituary and census verification, and direct outreach to heirs for ratifications, stipulative cross-conveyances, receiver-lease affidavits, or division order suspense releases.

Tip for signing the sheet: In the counties box below, list the specific counties where you have worked records, not just a state abbreviation.
